Please read these Terms and Conditions carefully before using this website or placing an order. By accessing the website or submitting an order, you agree to be bound by these terms. These terms must be read together with our Privacy Policy and any returns, delivery or promotional terms displayed on the website.

1. About us

Third Kultuur is an authorised licensee of Superdry and is entitled under a written licensing agreement to market and sell Superdry-branded products in South Africa. References to “Superdry” on the Website identify the licensed brand and products; the contracting seller for purchases made through the Website is Third Kultuur.

2. Application and acceptance

These terms apply to all visitors, account holders and customers using the Website. If you do not agree with them, you must not use the Website. Nothing in these terms is intended to exclude, restrict or waive any right that cannot lawfully be excluded under the Consumer Protection Act 68 of 2008 (“CPA”), the Electronic Communications and Transactions Act 25 of 2002 (“ECTA”) or any other applicable law.

If there is a conflict between these terms and a mandatory provision of applicable law, the mandatory legal provision will prevail.

3. Eligibility and customer information

You must have legal capacity to enter into a binding agreement. Where a person lacks full legal capacity, use of the Website and any purchase must be authorised or assisted by a parent, guardian or other legally authorised person.

You must provide information that is complete, accurate and current. You are responsible for keeping account credentials confidential and for activity conducted through your account, except where unauthorised activity results from our failure to apply reasonable security measures.

4. Products and availability

We take reasonable care to display product descriptions, colours, sizing and images accurately. Screen settings, lighting and manufacturing variations may cause minor differences. Product images are illustrative and packaging may differ.

Products and sizes are subject to availability. Placing an item in a basket does not reserve it. If an ordered item becomes unavailable, we will notify you and refund the amount paid for that item using the original payment method, unless another lawful arrangement is agreed with you.

5. Pricing

Prices are displayed in South African rand and include VAT where applicable, unless the Website clearly states otherwise. Delivery charges and any other applicable charges will be shown before you confirm payment.

We may change prices at any time before an order is accepted. If an obvious pricing or description error occurs, we may reject or cancel the affected order and provide a full refund. We will not rely on this clause to avoid a transaction where applicable consumer law requires us to honour the displayed price.

6. Orders and formation of the contract

1.       You submit an offer to purchase when you complete checkout and select the final order or payment confirmation button.

2.       An automated order acknowledgement confirms receipt of your order but does not necessarily constitute acceptance.

3.       The sale is accepted when we send a dispatch confirmation or otherwise expressly confirm acceptance.

4.       We may decline or cancel an order before acceptance for legitimate reasons, including lack of stock, suspected fraud, payment failure, an obvious error, delivery restrictions or breach of these terms.

If we cancel an order after receiving payment, we will process a refund to the original payment method as soon as reasonably practicable.

7. Payment

Payment options available on the Website may include Peach Payments, Apple Pay, Payflex and Mobicred. Availability and approval may depend on the relevant provider’s eligibility criteria and terms.

Payments are processed through third-party payment providers. We do not ordinarily receive or store your full payment-card details. You authorise the applicable provider and us to process the information required to complete and verify the transaction. Instalment, credit or deferred-payment arrangements are separate agreements between you and the relevant provider; their fees, credit decisions and repayment terms are governed by their own terms.

We use payment systems intended to meet accepted security standards, but no internet-based system can be guaranteed to be completely secure. You must not attempt to pay using an unauthorised payment method or another person’s payment credentials.

8. Delivery

We currently deliver to eligible addresses within South Africa, subject to the coverage displayed at checkout.

·         Estimated delivery timeframe: 1–4 working days after dispatch, subject to stock availability, payment clearance, delivery location and courier operations.

·         Standard delivery: R100.

·         Express delivery: R150. Express orders receive the expedited service made available at checkout, but the displayed timeframe remains an estimate unless we expressly guarantee a delivery date in writing.

Working days exclude Saturdays, Sundays and South African public holidays. Delivery estimates are not guarantees. We will notify you of a material delay where reasonably possible. Risk passes to you when the goods are delivered to you or to a person authorised by you to receive them.

You must provide a complete and accurate delivery address and ensure that someone is available to receive the parcel. Additional reasonable costs caused by an incorrect address, repeated failed delivery or refusal to accept a conforming order may be charged where permitted by law.

9. Change-of-mind returns

Subject to the exclusions below and your statutory rights, you may notify us within 7 working days after receiving an online order that you wish to cancel or return it. Contact service@superdry.co.za or 062 445 6258 and provide your order number and the items concerned.

Returned goods must be unworn, unused, unwashed and in a resaleable condition, with original tags attached and, where reasonably possible, in their original packaging. You must take reasonable care of the goods while they are in your possession.

For a change-of-mind return, you may be responsible for the direct cost of returning the goods, as permitted by ECTA. Any original delivery charge will be handled in accordance with applicable law and the circumstances of the cancellation. Refunds are processed to the original payment method after the returned goods have been received and assessed, subject to any lawful deduction for loss in value caused by handling beyond what is reasonably necessary to inspect the goods.

For hygiene and health reasons, returns may be restricted for sealed goods that have been opened after delivery, where the restriction is permitted by law and disclosed before purchase. Personalised, altered or specially made items may also be excluded from change-of-mind returns where permitted by law.

10. Incorrect, damaged, unsafe or defective goods

The 7-working-day change-of-mind period does not limit your statutory rights. If goods are incorrect, damaged on delivery, unsafe or defective, please contact us promptly with your order number and supporting information.

Under sections 55 and 56 of the CPA, qualifying defective or unsafe goods may be returned within six months after delivery, without penalty and at the supplier’s risk and expense. Depending on the circumstances and the customer’s lawful election, the available remedy may be repair, replacement or refund. These rights do not apply where goods were altered contrary to instructions, damaged through misuse, fair wear and tear, or a defect was specifically disclosed and accepted before purchase.

11. Exchanges

Exchanges are subject to stock availability. Where the requested replacement is unavailable, we may offer an alternative or process a refund in accordance with applicable law. Price differences and delivery charges may apply to voluntary exchanges, but not where doing so would improperly limit a statutory remedy.

12. Promotions, vouchers and discount codes

Promotions, vouchers and discount codes are subject to the specific terms displayed with the offer. Unless those terms state otherwise, they are not redeemable for cash, may not be combined, may be limited to one use per customer and may exclude selected products. We may withdraw or correct a promotion affected by fraud, abuse or an obvious error, subject to applicable law.

13. Website use

You may use the Website only for lawful personal or business purposes connected with browsing or purchasing our products. You must not:

·         introduce malicious code, interfere with security, overload the Website or attempt unauthorised access;

·         scrape, copy or commercially exploit Website content without permission;

·         submit false reviews, impersonate another person or use the Website fraudulently; or

·         infringe intellectual property, privacy or other rights.

We may suspend access where reasonably necessary to protect the Website, customers or our rights.

14. Intellectual property and brand licence

The Website and its content, including trade marks, logos, product names, photographs, graphics, text, software and layout, are owned by or licensed to Third Kultuur or the relevant rights holder. Superdry trade marks and brand assets are used under licence. No right or licence is granted to you except the limited right to use the Website for its intended purpose.

15. Third-party services and links

The Website may rely on or link to third-party services, including Shopify, payment providers, delivery partners, social-media platforms and marketing tools. Third parties may have their own terms and privacy notices. We are not responsible for an independent third-party website or service outside our reasonable control, but this does not exclude responsibility that applicable law places on us.

16. Reviews and user content

If you submit a review, photograph or other content, you confirm that it is truthful, lawful and does not infringe another person’s rights. You grant us a non-exclusive, worldwide, royalty-free licence to display, reproduce and adapt that content for operating and promoting the Website and products, subject to applicable privacy and consumer laws. We may moderate or remove unlawful, misleading or inappropriate content.

17. Disclaimers and limitation of liability

We aim to keep the Website accurate, secure and available, but maintenance, technical failures and events outside our reasonable control may cause interruptions. To the maximum extent permitted by law, we do not guarantee uninterrupted access or that every error will be corrected immediately.

Neither these terms nor any Website statement excludes liability for fraud, gross negligence, wilful misconduct, death or personal injury caused by negligence, defective goods where liability cannot lawfully be excluded, or any other liability that cannot be limited under South African law. Subject to those protections, we are not liable for indirect or consequential loss that was not reasonably foreseeable when the contract was formed.

18. Privacy and communications

Our collection and use of personal information are described in our Privacy Policy. Transactional messages about orders, payments, security and service are not marketing messages. Electronic direct marketing will be sent only where permitted by law, and each marketing communication will provide a reasonable way to opt out.

19. Complaints and dispute resolution

Please first contact us at service@superdry.co.za or 062 445 6258 so that we can try to resolve the matter.

Nothing in these terms prevents a consumer from referring a qualifying complaint to the Consumer Goods and Services Ombud, the National Consumer Commission, the Information Regulator, another competent regulator, an alternative dispute-resolution body or a court with jurisdiction, as applicable.

20. Governing law

These terms and transactions concluded through the Website are governed by the laws of the Republic of South Africa. South African courts have jurisdiction, subject to any right a consumer has to approach another competent forum.

21. Changes to these terms

We may update these terms to reflect legal, operational or Website changes. The updated version will be published with a revised effective date. Changes will not retrospectively remove rights that arose under an already accepted order.
